DEVELOPER Rosecorp and Swansea RSL will apply to the NSW Licensing Court to advance their plans for a $40 million development at Catherine Hill Bay.
They are planning 96 terraced apartments from two to five storeys on a cliff-top site in the village and plan to shift Catherine Hill Bay Bowling Club to the site.Last Tuesday, the Land and Environment Court rejected their arguments of "existing use" for the development. But it found the company could apply to the NSW Licensing Court to build housing as part of a club.Rosecorp said yesterday it would pursue that course. That position will be outlined today in the Land and Environment Court. It will also lodge an appeal against the court's decision.Catherine Hill Bay Progress Association secretary Brian Cogan said Swansea RSL was "now centre stage in this development".The Registered Clubs Act says that the Licensing Court shall not grant an application unless it includes "an approved plan of the proposed premises of the club showing clearly the accommodation proposed to be provided".Rosecorp and Swansea RSL do not have an approved plan.Swansea RSL president James Taylor said the club would continue to back Rosecorp. He agreed that the proposed club would not be viable if it did not include 96 apartments.Mr Taylor said the Licensing Court had given the club permission to amalgamate with the bowling club.
